Prop 45

Environmental Review

What it is

Proposition 45 would speed up the review process for the California Environment Quality Act (CEQA) by setting deadlines and resolving lawsuits. CEQA already requires an agency to consider how a project might impact the environment before approving it. These projects include housing developments, school facilities and highway expansions. This measure would create more binding time limits for state and local governments to fulfill CEQA and permitting reviews. Proposition 45 would also limit the scope of what a court can consider in CEQA lawsuits and would prevent a court from stopping a whole project if it found an agency did not follow CEQA properly.

Full official text here.

What Your Vote Means

Voting YES

Certain public and private projects would be eligible for new project review and court challenge procedures. For example, new procedures would tighten time limits for environmental review and reduce the scope of what courts can consider when reviewing legal challenges.

Voting NO

Public and private projects would continue to use existing project review and court challenge procedures.

Arguments

Supporters say

Proposition 45 would address California’s high cost of living by cutting red tape that slows building in the state, while maintaining California’s strong environmental protections. California Children’s Hospital Association, California Water Association and California Council for Affordable Housing are among the groups that support the measure.

More arguments here.

Opponents say

Proposition 45 would gut CEQA, protect corporate profits over public health and would not lower costs. Coalition for Clean Air, California Environmental Voters, Physicians for Social Responsibility Los Angeles and National Wildlife Federation are among the groups that oppose the measure.

More arguments here.

Fiscal Impact

Initial costs for state and local governments, likely in the high tens of millions of dollars—potentially exceeding $100 million—annually, partly covered by fees. Uncertain, potentially more significant positive or negative longer-term fiscal effects.
